Jamaica Resident Travel Terms & Conditions

1. General Booking Terms

​

Trip-specific details, including itinerary, inclusions, payment schedule, cancellation deadlines, and special conditions may vary by trip. Where trip-specific terms differ from these General Terms & Conditions, the trip-specific terms will apply.

 

1.b Reservation Confirmation

Travellers understand that their reservation is considered confirmed only after payment has been received, processed, and a written confirmation has been provided by Bella Bear Gift & Travel Services.

Submission of an inquiry, quote request, or registration form does not guarantee availability, pricing, or reservation confirmation.

 

2. Payment Terms

​

Payments must be made through the secure Lasco Biz payment link.

​

Payment confirmations are issued within 3 business days of payment being reflected in Bella Bear Gift & Travel Services' bank account.

​

Travellers are responsible for ensuring payments are received by the applicable deadlines.

​

Bella Bear Gift & Travel Services is not responsible for delays caused by banking institutions, payment processors, incorrect payment information, or technical issues outside of our control.

​

All deposit payments made to Bella Bear Gift & Travel Services are non-refundable and non-transferable under any circumstances.

​

All prices are subject to change until a deposit is received and the booking is secured. Full payment must be made by the stated final payment deadline. Failure to make payments by the required deadlines may result in cancellation of the reservation and forfeiture of payments made.

​

Monthly payment plans are a convenience offered by Bella Bear Gift & Travel Services and do not represent a layaway arrangement. Travelers remain responsible for ensuring the full balance is paid by the final payment deadline, regardless of missed monthly installments.

 

3. Cancellation Policy

Travelers requesting cancellation must notify Bella Bear Gift & Travel Services in writing.

Cancellation requests should be submitted no later than 14 days prior to arrival where possible; however, cancellation at any time remains subject to applicable cancellation terms, supplier penalties, and amounts already paid.

 

Cancellation requests must be sent to:

Requests must include:

  • Traveler’s full name

  • Invoice number

  • Date of travel

Cancellation is effective on the date the written notice is received.

If you do not receive acknowledgment within 48 hours, please contact 876-790-9565 to confirm receipt.

Cancellations made after this period, or failure to travel (no-show), may result in additional penalties, including full loss of funds, as determined by the hotel and suppliers.

 

4. Reservation Changes

Any change to an existing reservation may result in a change fee, plus applicable supplier fees.

This includes, but is not limited to:

  • Name corrections

  • Room changes

  • Occupancy changes

  • Date changes

  • Removal of services

Changes requested after supplier documents have been issued may require cancellation and rebooking.

There are no refunds for unused services.

 

5. Hotel & Resort Accommodations

Room type, bed type, and special requests are submitted on the traveler’s behalf but are not guaranteed.

All room requests are subject to resort availability and final confirmation by the resort.

Check-in and check-out times are determined by the resort.

Bella Bear Gift & Travel Services reserves the right to substitute a resort with one of equal standard if necessary due to availability, supplier issues, or other circumstances beyond our control.

 

6. Group Trip Policies

Group departure dates, itineraries, inclusions, and activities are subject to change based on supplier confirmation, weather, minimum participation, and other operational needs.

Bella Bear Gift & Travel Services may adjust the order of activities, substitute vendors, or make similar changes when necessary.

We cannot guarantee the number of participants on any group trip.

For group bookings, all payments are non-refundable and non-transferable unless otherwise stated in writing.

All unused services are non-refundable.

​

 

7. Group Conduct & Participation

Travelers are expected to behave respectfully toward other guests, staff, suppliers, and members of the group.

Harassment, violence, illegal activity, excessive disruption, or behavior that negatively impacts the safety or enjoyment of others may result in removal from the trip.

Bella Bear Gift & Travel Services reserves the right to decline or remove any traveler whose conduct is disruptive, unsafe, or incompatible with the group.

Any expenses caused by removal, including alternate transportation or accommodations, are the traveler’s responsibility.

 

8. Traveler Responsibilities

Travelers are responsible for ensuring that all personal details provided, including full name(s) and date(s) of birth, are accurate and match valid government-issued identification.

Bella Bear Gift & Travel Services will not be held liable for errors submitted by travelers.

Travelers are responsible for their personal belongings throughout the trip.

Bella Bear Gift & Travel Services is not responsible for lost, stolen, damaged, or misplaced items.

 

9. Joint Acceptance of Terms & Conditions

For reservations involving multiple travelers, the person submitting the reservation form confirms that the reservation details and these Terms & Conditions have been discussed with all travelers included on the booking.

Submission of the form by one traveler constitutes acceptance of these Terms & Conditions on behalf of all travelers listed on the reservation.

All travelers will be bound by applicable payment schedules, cancellation policies, and travel requirements.

 

10. Release From Liability

Bella Bear Gift & Travel Services does not own or operate resorts, airlines, transportation providers, excursion companies, or other third-party vendors used in travel arrangements.

All such providers are independent contractors and are solely responsible for their own acts, omissions, services, and policies.

Bella Bear Gift & Travel Services is not responsible for injury, loss, damage, delay, inconvenience, or death arising from:

  • Acts of God

  • Government action

  • Force majeure

  • War

  • Civil unrest

  • Strikes

  • Criminal activity

  • Overbooking

  • Equipment failure

  • Defective conditions

  • Illness

  • Epidemic

  • Sanitation issues

  • Transportation issues

  • Any event outside our direct control

To the fullest extent allowed by law, travelers release Bella Bear Gift & Travel Services from liability for claims arising from third-party acts or omissions and risks inherent in travel.

 

11. Assumption of Risk

Travelers understand that travel involves risks including illness, injury, death, delay, and inconvenience.

Travelers understand that:

  • Weather may be severe

  • Medical services may be limited

  • Conditions may change without notice

Travelers voluntarily accept these risks as part of the travel experience and accept responsibility for any loss, injury, or damage that may occur unless otherwise required by law.

Travelers must be physically, mentally, and medically able to participate in the selected trip.

Travelers are responsible for their own alcohol consumption and behavior.

Bella Bear Gift & Travel Services is not responsible for consequences resulting from excessive alcohol use, intoxication, or related conduct.

Travelers authorize Bella Bear Gift & Travel Services or local partners to seek emergency medical treatment if reasonably necessary during travel.

 

12. Minimum Group Size & Trip Cancellation

Some group trips require a minimum number of confirmed, paid travelers to proceed.

If the minimum number is not reached by the deadline stated for the trip, Bella Bear Gift & Travel Services reserves the right to cancel the group trip.

If a group trip is cancelled due to insufficient participation, travelers will be offered options stated in the trip-specific terms, which may include:

  • Booking independently at the prevailing individual rate

  • Transferring funds to another trip

  • Receiving a refund if stated in the specific trip terms

Any deposit refundability in this circumstance will be determined by the trip-specific terms.

 

13. Dispute Resolution

Any dispute, claim, or disagreement arising from these Terms & Conditions, the booking process, travel arrangements, marketing materials, services provided, or the trip itself shall be governed by and interpreted in accordance with the laws of Jamaica.

The parties agree to make reasonable efforts to resolve any concerns or disputes through good-faith communication before pursuing formal legal action.

If a resolution cannot be reached, any legal proceedings shall be brought before the appropriate courts of Jamaica with jurisdiction over the matter.

By agreeing to these Terms & Conditions, travelers acknowledge that they have read, understood, and accepted the terms governing their booking and the services provided by Bella Bear Gift & Travel Services.

 

14. Voluntary Participation & Agreement

Travelers acknowledge they have voluntarily chosen to participate in the trip described in booking materials and on the Bella Bear Gift & Travel Services website.

Travelers confirm they have reviewed trip details and understand they are participating voluntarily with knowledge of associated risks.

Travelers confirm they have carefully read these Terms & Conditions and understand their contents.

Travelers understand this agreement is a binding contract between themselves and Bella Bear Gift & Travel Services.

Travelers agree to these Terms & Conditions freely and voluntarily for themselves and anyone traveling with them, including minor children under their care.

 

15. Photography Release

Bella Bear Gift & Travel Services may take photographs or video during trips.

By traveling with Bella Bear Gift & Travel Services, participants grant permission for use of images for promotional, marketing, or commercial purposes without compensation unless prohibited by law.

 

16. Website Terms

Use of Website

Your use of www.bellabearjm.com constitutes agreement to the terms, conditions, and notices contained on the website and in these Terms & Conditions.

17. Website Liability Disclaimer

Information, products, and services posted on the website may contain inaccuracies, typographical errors, or outdated information.

Content may be updated at any time without notice.

Bella Bear Gift & Travel Services is not liable for direct, indirect, incidental, consequential, or special damages arising from use of the website or information obtained through it, to the fullest extent permitted by law.

18. Links to Other Websites

The website may contain links to third-party websites.

These links are provided for convenience only.

Bella Bear Gift & Travel Services does not control third-party websites and is not responsible for their content, policies, or practices.

 

19. Communication Policy

Please allow up to 24 business hours for a response, although some responses may be quicker.

During busy periods, communication may take longer than usual.

Clients currently traveling will be prioritized, followed by clients with upcoming travel.

 

20. Chargebacks

Before initiating a chargeback, travelers agree to contact Bella Bear Gift & Travel Services directly to attempt resolution.

If a chargeback is filed without prior communication, Bella Bear Gift & Travel Services reserves the right to submit supporting documentation to the payment processor or financial institution.

21.Fraudulent Chargebacks

Chargebacks filed without valid reason or without prior communication may be considered a breach of this agreement.

Bella Bear Gift & Travel Services reserves the right to pursue legal remedies to recover losses, including legal fees and related expenses, where permitted by law.
